SUPREME COURT JUNKS PETITION VS DUTERTE YOUTH PARTYLIST

THE SUPREME Court has dismissed the petition filed by several groups questioning the proclamation by the Commission on Elections of Ducielle Cardema as representative of the Duterte Youth Partylist.

In a notice dated November 3, 2020, but only made public on Tuesday, January 26, 2021, the court dismissed the petition for failing to show that the poll body committed grave abuse of discretion.

“The Court resolved to dismiss the petition for failure to sufficiently show that the Commission on Elections committed grave abuse of discretion in rendering the challenged minute resolutions which, on the contrary, appear to be in accord with the facts and applicable law and jurisprudence,” the resolution read.

The youth leaders asked the SC to issue a status quo ante order and writ of preliminary injunction.

They filed the petition against the partylist on October 26, 2020, following the assumption of Cardema.

Ducielle replaced her husband, Ronald Cardema, the group’s first nominee and former National Youth Commission chairman.

In August 2019, the Comelec’s First Division canceled Ronald’s nomination, saying he was too old to be the group’s nominee.
