SIGALOT SA CAGAYAN STATE U PRESIDENCY TULOY PA RIN; CAMPUS EXECS SUMUPORTA KAY ALVARADO
HINDI pa rin natutuldukan ang sigalot sa kung sino ang dapat na maupong presidente ng Cagayan State University matapos na muling magpalitan ng pahayag ang dalawang magkalabang kampo.
Sa pinakahuling resolusyong ipinaskil sa Facebook ni CSU Vice President Rev. Ranhilio Aquino ay nagkakaisa umano ang campus executive officers mula sa anim sa walong kampus na tanging si incumbent and reappointed President Urdujah Alvarado lamang ang kanilang kikilalaning pangulo at pinuno ng pamantasan.
Ito ay sa kabila ng patuloy na paggigiit ni dating Commission on Higher Education Region II Director Julieta Paras sa CHED En Banc na nagluluklok umano sa kaniya bilang OIC President ng CSU.
Nakasaad sa resolusyon ni Aquino na ang buong pamantasan ay nakatanggap ng ‘valid mandate’ mula sa Lupon ng mga Rehente na nagpapatunay na si Alvarado pa rin ang presidente ng pamantasan mula 2020 hanggang 2024, at wala silang ibang susunding mandato maliban dito.
“Whereas we, Campus Executive Officers of the eight (8) campuses of the Cagayan State University are convinced that President Urdujah G. Alvarado received a valid mandate from the Board of Regents to lead the university for a second term from 2020 to 2024,” nakasaad sa resolusyon.
“Now therefore be it resolved, as it is hereby resolved, that the campuses of the University will recognize only such orders as are issued by President Urdujah G. Alvarado and to leave the resolution of legal issues to the courts.”
Walong CEO ang orihinal na nakalagda sa resolusyon, pero matapos ang ilang oras ay naglabas ng hiwalay na dokumento ang dalawang CEO na bumabawi sa unang paglagda.
Ayon kina Dr. Vicente Binasoy ng Piat Campus at Dr. Ricardo Casauay ng Lal-lo Campus, pumapanig na sila ngayon kay Paras matapos na maliwanagan sa tunay na pangyayari.
“After reading the press release of Director Julieta Paras which is a narrative of events that transpired in the university, we were enlightened, thus we are withdrawing our signature from the resolution which we signed yesterday.”
Nagsaad pa ng kasalukuyang kalagayan si Binasoy, partikular sa kaniyang nakaambang pagreretiro.
“Should a legal charge against us materialize, it will be detrimental to me and my family as it will dramatically impede my (Dr. Binasoy) application for retirement, which in my case will be due in a few months from now.”
“Therefore, as much as the above issues are already in the jurisdiction of the courts, we regret to withdraw our signatures in the said resolution. We hope and pray the withdrawal of our signatures in the said resolution will not be the measure of our loyalty and commitment to our beloved university,” pagtatapos ng dalawang CEO.
6FSa Kampo ni Alvarado
Itinalaga ng CHED Cagayan si Paras bilang OIC President ng Cagayan State University sa pamamagitan ng CHED En Banc noong Disyembre 16.
Gayunpaman, sa kabila ng dokumentong ito’y umalma si incumbent at ‘reappointed’ President Alvarado.
Umaga ng Disyembre 16 ay tumungo si Paras sa CSU Andrews Campus bitbit ang dokumentong mula sa En Banc saka nakipagtalakayan sa kampo ni Alvarado. Sa harap ng mga abogado at iba pang kawani ng opisina’y iginigiit niyang marapat na siya (Paras) na ang umupong pangulo ng unibersidad simula pa noong Oktubre.
Hindi naman nagpatinag si Alvarado. Iginiit niya at ng buong pamunuan na ang desisyon ng En Banc ay problematiko, hindi kinikilala, at pinoprotesta ng buong pamantasan.
Susog ni CSU Vice President Aquino, naglabas na ng desisyon ang Aparri Trial Court at binigyan si Alvarado ng Writ of Preliminary Injuction. Ito ang desisyong pumipigil sa CHED “from acting, executing, and implementing orders in relation to the appointment of an OIC as caretaker of CSU and/or taking other measures meant to prevent President Alvarado from exercising her function as president of CSU from the term October 8, 2020 until October 7, 2024.”
Ang Writ of Preliminary Injuction ang inilalaban ng kampo kontra Paras, na anila’y nagpraktika ng self-appointment na hindi kailanman kinilala ng Lupon ng mga Rehente.
Ang kilos ng En Banc at ang pagpupumilit ni Paras na iluklok ang sarili bilang pangulo ng pamantasan ay labag umano sa Republic Act 8292 na nagsasabing ang anumang pagtatalaga ay dapat na ratipikado ng BOR.
Sa seksyon 6 ay nakasaad na: “In case of vacancy by reason to death, resignation, removal for cause or incapacity of the president to perform the functions of his office, the Board shall have the authority to designate an officer-in-charge pending the appointment of a new president.”
Naglabas ng opisyal na pahayag si Alvarado sa kaniyang Facebook page ukol dito. Idiniriin niyang walang bisa ang desisyon ng En Banc at walang ibang pangulo ang pamantasan maliban sa kaniya.
“The CHED director presented herself at CSU exhibiting a resolution of the CHED En Banc designating herself as OIC President, this despite the fact that there is a current Writ of Preliminary Injunction that prohibits the CHED chair from interfering with my discharge of the duties and powers of the office of the president,” ayon kay Alvarado.
Gayundin, dahil sa sigalot na ito’y naghahanda na ang kaniyang kampo sa mga kasong posibleng isampa laban sa CHED at kay Paras.
“Our lawyers are now preparing the necessary action for redress including indirect contempt charges against the whole Commission on Higher Education and the Regional Director,” diin niya.
Tugon ng Kampo ni Paras
Sagot ni Paras kina Alvarado at Aquino, “I have been designated by no other than the Commission En Banc, to be the OIC President of Cagayan State University. There is a legal basis for that. Alam naman natin lahat that since October 8, that the position of presidency in CSU is considered vacant because the term of the president expired October 7, 2020. So, she has no authority to occupy such a position.”
Kampo naman ni Paras ang nagsasabing ang Writ of Preliminary Injuction, na siyang natatanging panlaban ng kampo ni Alvarado ay hindi maaaring gamitin dahil ito ay pending pa.
“The writ of preliminary injunction issued by Branch 6 of Regional Trial Court of Aparri, Cagayan in SP Civil Case No. II-6457 entitled ‘Dr. Urdujah G. Alvarado v. The Chairman of the Board of Regents, Cagayan State University’ is not yet final, considering that it is still the subject of a motion for reconsideration now pending before Branch 9 of the same court,” pahayag ni Paras sa Facebook page ng CHED Regional Office 2.
Susog na paliwanag, “the Republic of the Philippines, through the Office of the Solicitor General, filed a quo warranto petition against Dr. Urdujah [Alvarado] stated, among others, that the elements of a valid appointment were not complied with, and prayed that the Regional Trial Court of Manila declared as void Board Resolution No. 24, Series of 2020, which reappoints Dr. [Alvarado] as CSU President commencing on October 8, 2020. Dr. [Alvarado] recognized the propriety of this remedy to contest her title in her letter dated June 25, 2020 addressed to CHED Commissioner Perfecto A. Alibin.”
